14.12 User data is stored and processed exclusively within secure, compliant data centres located in the United Kingdom or the European Economic Area (EEA). No data is transferred outside these jurisdictions unless required by law and subject to appropriate safeguards.
14.13 Users are encouraged to report any suspected security vulnerabilities or incidents to the privacy contact at hello@goodfor.app for prompt investigation and resolution.
15.1 GoodFor.app may provide links to, or integrate with, external websites, applications, services, or resources operated by third parties. These may include, but are not limited to, product retailer websites, ingredient or allergen reference sources, third-party authentication or login providers, and payment processors. Such third-party links and integrations are offered to enhance the functionality, convenience, and user experience of the platform.
15.2 Users are advised that when accessing or interacting with third-party websites, services, or integrations via GoodFor.app, the terms of service, privacy policies, and practices of those third parties will apply. GoodFor.app does not control, endorse, or assume responsibility for the content, accuracy, security, or privacy practices of any third-party websites, services, or integrations.
15.3 Users are strongly encouraged to review the terms of service and privacy policies of any third-party websites or services before providing personal data, making purchases, or engaging with their features. GoodFor.app is not responsible for any loss, damage, or liability arising from users’ interactions with third-party sites or services.
15.4 GoodFor.app does not share users’ personal data with third-party websites or services when users follow external links or use third-party integrations, except where explicitly stated and with the user’s informed consent, or as required by law. Where integration with third-party authentication or login systems is provided (such as social media or single sign-on providers), only the minimum information necessary to facilitate authentication will be processed, and such processing will be subject to the privacy policy of the relevant third-party provider.
15.5 GoodFor.app is not responsible for any personal data that users choose to provide directly to third-party websites, services, or integrations. Any data provided in this manner is subject to the third party’s own privacy and data protection practices, and users do so at their own risk.
15.6 GoodFor.app regularly reviews the third-party links and integrations offered within the platform to ensure they remain relevant, secure, and appropriate for users, including children and families. If a third-party link or integration is found to present a risk to user privacy, security, or the integrity of the platform, GoodFor.app will take reasonable steps to remove or disable access to such third-party content as soon as practicable.
15.7 Users may contact GoodFor.app’s support team at hello@goodfor.app for further information about third-party links and integrations, or to report concerns regarding any third-party content accessible via the platform.
15.8 This section is reviewed annually as part of GoodFor.app’s policy review process and may be updated to reflect changes in third-party relationships, legal requirements, or user expectations. Notice of material changes will be provided in accordance with the update and notification provisions of these Terms.
16.1 The GoodFor Company is committed to resolving any disputes, claims, or disagreements that may arise in connection with your use of GoodFor.app, whether as a website visitor, registered user, parent/guardian, or child user (with parental consent), in a fair, efficient, and cost-effective manner.
16.2 In the event of any dispute, controversy, or claim relating to these Terms of Service & Conditions, the use of GoodFor.app, or any related services, you agree to follow the procedures set out below before pursuing any court action:
a) You must first contact our support team at hello@goodfor.app to attempt to resolve the issue informally. Please provide full details of your concern or complaint, including any relevant supporting information.
b) If the dispute cannot be resolved informally within thirty (30) days of your initial contact, either party may request that the matter be referred to mediation. Mediation will be conducted by a neutral third-party mediator, mutually agreed upon by both parties, and will take place in London, England, unless otherwise agreed.
c) If mediation does not result in a resolution within a further thirty (30) days, either party may refer the dispute to binding arbitration, to be conducted in accordance with the rules of the London Court of International Arbitration (LCIA) or another recognised arbitration body as agreed by the parties. The language of arbitration shall be English.
d) Nothing in this section prevents either party from seeking urgent interim relief (such as an injunction) from a court of competent jurisdiction where necessary to protect their rights or interests.
16.3 All mediation and arbitration proceedings shall be confidential, and neither party shall disclose the existence, content, or outcome of any such proceedings except as required by law or for the purpose of enforcing or challenging an arbitration award.
16.4 The costs of mediation and arbitration, including the mediator’s or arbitrator’s fees, shall be shared equally between the parties, unless otherwise determined by the mediator or arbitrator. Each party shall bear its own legal and other costs, unless the mediator or arbitrator decides otherwise.
16.5 By accepting these Terms of Service & Conditions, you agree that the dispute resolution procedures set out in this section are mandatory and must be followed before commencing any legal proceedings in court, except where urgent interim relief is required.
16.6 This dispute resolution clause is governed by the laws of England and Wales. Any court proceedings permitted under this section shall be brought exclusively in the courts of England and Wales.
17.1 The GoodFor Company provides GoodFor.app and all related services, content, and features on an “as is” and “as available” basis. To the fullest extent permitted by law, The GoodFor Company, its directors, officers, employees, agents, licensors, and affiliates expressly disclaim all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability.
17.2 Nothing in these Terms shall exclude or limit liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
17.3 Subject to clause 17.2, The GoodFor Company shall not be liable to any user, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any:
a) Loss of profits, revenue, business, contracts, anticipated savings, goodwill, or data, whether direct or indirect.
b) Indirect, consequential, special, or punitive loss or damage, even if foreseeable or if The GoodFor Company has been advised of the possibility of such damages.
c) Loss or damage arising from reliance on information, recommendations, or insights provided by GoodFor.app, including but not limited to health, allergen, or product suitability information.
17.4 The total aggregate liability of The GoodFor Company to any user for any and all claims arising out of or in connection with the use of GoodFor.app or these Terms, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the greater of:
a) The total amount paid by the user to The GoodFor Company for the use of GoodFor.app in the twelve (12) months preceding the event giving rise to the claim; or
b) One hundred pounds sterling (£100).
17.5 Users acknowledge and agree that GoodFor.app is intended to provide general product, health, and allergen information for informational purposes only. The GoodFor Company does not provide medical, dietary, or professional advice, and users are solely responsible for verifying product suitability and seeking independent professional advice where appropriate.
17.6 The GoodFor Company shall not be liable for any failure or delay in performance of its obligations under these Terms arising from any cause beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, labour disputes, technical failures, or interruptions to third-party services.
17.7 Users are responsible for ensuring that their use of GoodFor.app is in compliance with all applicable laws and regulations in their jurisdiction. The GoodFor Company shall not be liable for any loss or damage arising from unauthorised, unlawful, or improper use of the service.
17.8 Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such cases, the exclusions and limitations set out in this section shall apply to the fullest extent permitted by applicable law.
17.9 This limitation of liability forms an essential basis of the agreement between users and The GoodFor Company regarding the use of GoodFor.app. Users’ statutory rights as consumers are not affected.
18.1 As a condition of your use of GoodFor.app, the website, and any related services provided by The GoodFor Company Ltd, you agree to indemnify, defend, and hold harmless The GoodFor Company Ltd, its directors, officers, employees, agents, affiliates, licensors, and service providers from and against any and all claims, demands, actions, proceedings, liabilities, damages, losses, costs, and expenses (including reasonable legal fees and costs) arising out of or in connection with:
a) your access to or use of GoodFor.app, the website, or any related services, including any content, data, or information you submit, post, or transmit through the platform;
b) any breach by you of these Terms of Service & Conditions, the Privacy Policy, or any applicable law, regulation, or third-party right;
c) any misuse, unauthorised use, or prohibited activity conducted through your account, including but not limited to the submission of false, misleading, or unlawful information, or the introduction of malware, viruses, or harmful code;
d) any claim that your use of GoodFor.app or any content you provide infringes or violates the intellectual property, privacy, or other rights of any third party;
e) any dispute or issue between you and any other user or third party in connection with your use of GoodFor.app or the website.
18.2 The GoodFor Company Ltd reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you. In such cases, you agree to cooperate fully with The GoodFor Company Ltd in asserting any available defences and in the conduct of such defence.
18.3 This indemnity obligation will survive the termination or expiration of your account, your use of GoodFor.app, and these Terms of Service & Conditions. It applies to all claims, losses, and liabilities, whether arising during or after the period of your use of the service.
18.4 You must not settle any claim or matter subject to indemnification under this section without the prior written consent of The GoodFor Company Ltd. The GoodFor Company Ltd will not unreasonably withhold or delay such consent, but reserves the right to participate in or assume the defence of any such matter at its discretion.
18.5 The indemnity provided in this section is in addition to, and not in limitation of, any other rights or remedies available to The GoodFor Company Ltd under law, equity, or otherwise.
19.1 The GoodFor Company reserves the right to amend, update, or modify these Terms of Service & Conditions at any time to reflect changes in legal requirements, regulatory guidance, business operations, or the features and functionality of GoodFor.app. Any such changes will be made at the sole discretion of The GoodFor Company and will take effect as specified in the notice provided to users.
19.2 Users will be notified of any material changes to these Terms by a clear and prominent notice posted on the GoodFor.app website and within the mobile applications. Where changes are significant or impact users’ rights or obligations, additional notice may be provided via email or in-app notification, as appropriate.
19.3 The updated Terms of Service & Conditions will indicate the date of the most recent revision at the top of the document. Users are encouraged to review the Terms periodically to remain informed about their rights, responsibilities, and the conditions governing use of GoodFor.app.
19.4 Continued use of GoodFor.app or any related services following the publication of updated Terms constitutes acceptance of the revised Terms. If a user does not agree to the changes, they should discontinue use of the service and may request account deletion in accordance with the procedures set out in these Terms.
19.5 The GoodFor Company is committed to transparency regarding any amendments to these Terms. Users may contact the support team at hello@goodfor.app with any questions or concerns about changes or their implications.
19.6 Where updates are required by law or regulatory authorities, The GoodFor Company will implement such changes promptly and notify users as required to ensure ongoing compliance with all applicable regulations, including but not limited to UK GDPR, EU GDPR, COPPA, and CCPA.
19.7 If changes relate to the processing of children’s data or parental consent procedures, The GoodFor Company will take additional steps to inform parents or guardians, and obtain renewed consent if necessary, to ensure the continued protection of children’s rights and compliance with relevant laws.
19.8 Users may request a copy of the current or any previous version of the Terms of Service & Conditions by contacting hello@goodfor.app. The GoodFor Company maintains records of all previous versions to ensure transparency and accountability.
19.9 If a user is dissatisfied with any change to the Terms, they may submit a complaint or concern to hello@goodfor.app. If the response is unsatisfactory, users have the right to escalate their complaint to the UK Information Commissioner’s Office (ICO) or the relevant supervisory authority in their jurisdiction.
20.1 These Terms of Service & Conditions, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them, their subject matter, or formation, shall be governed by and construed in accordance with the laws of England and Wales.
20.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms, their subject matter, or formation, except as expressly set out below.
20.3 Before commencing any court proceedings, users and The GoodFor Company agree to attempt to resolve any dispute, controversy, or claim relating to these Terms or the use of GoodFor.app through good faith negotiations and, if necessary, mediation or arbitration, unless urgent injunctive relief is required.
20.4 Notwithstanding the above, The GoodFor Company reserves the right to seek interim, injunctive, or equitable relief in any jurisdiction where such relief is necessary to protect its rights, intellectual property, or confidential information.
20.5 Users who access or use GoodFor.app from outside England and Wales are responsible for compliance with all applicable local laws. If local laws prohibit or restrict the use of GoodFor.app, users must refrain from using the service in those jurisdictions.
20.6 If any provision of this section is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
21.1 If any provision or part-provision of these Terms of Service & Conditions is found by any court or competent authority to be invalid, unlawful, or unenforceable, that provision or part-provision shall, to the extent required, be deemed to be deleted and the validity and enforceability of the remaining provisions of these Terms shall not be affected.
21.2 The parties agree that if any invalid, unlawful, or unenforceable provision of these Terms would be valid, lawful, and enforceable if some part of it were deleted or modified, the provision shall apply with the minimum modification necessary to make it valid, lawful, and enforceable, while preserving, as far as possible, the original intent of the parties.
21.3 In the event that any provision is deemed severed, the remainder of these Terms will continue in full force and effect, and the parties shall negotiate in good faith to agree to a replacement provision that, to the greatest extent possible, achieves the intended commercial result of the original provision.
21.4 The severability of any provision under this section shall not affect any other rights, obligations, or remedies of either party under these Terms, nor shall it affect the enforceability of any other provision.
21.5 This section is intended to ensure that these Terms remain effective and enforceable even if any individual provision is found to be defective, and to minimise disruption to the contractual relationship between users and The GoodFor Company.
22.1 The GoodFor Company shall not be liable for any failure or delay in performing its obligations under these Terms of Service & Conditions where such failure or delay results from any event, circumstance, or cause beyond its reasonable control (a “Force Majeure Event”).
22.2 Force Majeure Events include, but are not limited to, acts of God, natural disasters, fire, flood, earthquake, storm, epidemic or pandemic, war, armed conflict, terrorism, civil commotion, riot, government action or intervention, strikes, lockouts, labour disputes, failure of suppliers or subcontractors, interruption or failure of utility services, telecommunications or internet outages, or any other event which could not have been reasonably foreseen or prevented by The GoodFor Company.
22.3 During the period of a Force Majeure Event, the obligations of The GoodFor Company under these Terms shall be suspended to the extent that performance is prevented, hindered, or delayed by such event. The Company will use reasonable endeavours to mitigate the impact of the Force Majeure Event and to resume full performance as soon as reasonably practicable.
22.4 If a Force Majeure Event continues for a period exceeding thirty (30) consecutive days, either party may terminate the affected services or these Terms of Service & Conditions by providing written notice to the other party, without liability for any resulting damages or losses, except for any outstanding payment obligations incurred prior to the Force Majeure Event.
22.5 The GoodFor Company will promptly notify users, via the website, app, or registered email address, upon becoming aware of a Force Majeure Event that materially affects the availability or operation of the GoodFor.app platform or services. Such notice will include reasonable details of the nature of the event, its anticipated duration, and the steps being taken to address or mitigate its effects.
22.6 Users acknowledge and agree that The GoodFor Company shall not be liable for any loss of data, interruption of service, delay, or failure to perform resulting from a Force Majeure Event, provided that the Company has taken reasonable steps to prevent or minimise such impact.
22.7 Nothing in this section shall excuse or delay the payment of any fees or charges due and payable by users for services already provided prior to the occurrence of a Force Majeure Event.
22.8 The rights and remedies set out in this section are in addition to, and do not limit, any other rights or remedies available to The GoodFor Company under these Terms or at law.
23.1 The failure or delay by GoodFor Company to exercise or enforce any right, power, or provision under these Terms of Service & Conditions shall not constitute a waiver of that right, power, or provision, nor shall it be deemed to be a continuing waiver of any subsequent breach or default by any user.
23.2 Any waiver of any provision of these Terms of Service & Conditions will be effective only if it is expressly stated in writing and signed by an authorised representative of GoodFor Company. No waiver by GoodFor Company of any breach or default shall be deemed a waiver of any preceding or subsequent breach or default.
23.3 Users may not rely on any act, omission, or conduct by GoodFor Company as a waiver of any right or remedy unless such waiver is provided in writing. The exercise of any right or remedy by GoodFor Company under these Terms of Service & Conditions shall be without prejudice to any other rights or remedies available to GoodFor Company under law or equity.
23.4 No single or partial exercise of any right, power, or privilege by GoodFor Company shall preclude any other or further exercise of that or any other right, power, or privilege.
23.5 Users acknowledge that strict compliance with these Terms of Service & Conditions is required and that any waiver granted by GoodFor Company in a particular instance does not alter or affect the enforceability of the remaining provisions or the requirement for future compliance.
24.1 These Terms of Service and Conditions, together with the Privacy Policy and any other documents expressly incorporated by reference, constitute the entire agreement between you and The GoodFor Company Ltd regarding your access to and use of GoodFor.app, the GoodFor website, and all related services, features, and content provided by The GoodFor Company Ltd.
24.2 This agreement supersedes and extinguishes all prior agreements, representations, warranties, understandings, or arrangements (whether written or oral) between you and The GoodFor Company Ltd relating to the subject matter herein, except as expressly set out in these Terms.
24.3 You acknowledge that, in entering into this agreement, you have not relied on any statement, representation, assurance, or warranty (whether made innocently or negligently) that is not expressly set out in these Terms of Service and Conditions or the Privacy Policy.
24.4 No additional terms, conditions, or policies communicated by you, or implied by trade, custom, practice, or course of dealing, shall be binding on The GoodFor Company Ltd unless expressly agreed in writing by an authorised representative of The GoodFor Company Ltd.
24.5 If any provision of these Terms of Service and Conditions is found to be invalid, unlawful, or unenforceable by a court or competent authority, such provision shall be deemed severed from the remainder of the agreement, which shall remain in full force and effect.
24.6 Any failure or delay by The GoodFor Company Ltd to exercise any right or remedy provided under these Terms or by law shall not constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy.
24.7 The headings in these Terms are for convenience only and shall not affect their interpretation.
